Welcome to Quikit! These Terms of Service (“Terms”) govern your use of our platform, including our website, mobile application, and related services (collectively, “Platforms”). By accessing or using Quikit, you agree to be bound by these Terms. Please read them carefully before using the Platforms. If you do not agree to these Terms, you must discontinue use of the Platforms.
1. Acceptance of Terms
By accessing or using Quikit’s Platforms, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you are using Quikit on behalf of a company or organization, you represent that you are authorized to bind that entity to these Terms.
If you do not agree with any part of these Terms, you should not use Quikit’s Platforms.
2. Use of the Platforms
You agree to use Quikit only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit, anyone else’s use and enjoyment of the Platforms. Prohibited behavior includes, but is not limited to:
- Uploading any content that is illegal, harmful, or violates any third-party rights (including intellectual property or privacy rights)
- Engaging in harassment, impersonation, or any form of abuse towards other users or third parties
- Attempting to interfere with the security or proper functioning of the Platforms through hacking, spamming, or introducing malware
- Reverse engineering or attempting to extract the source code of the Platforms without express authorization
Quikit reserves the right to terminate or restrict your account without notice if you violate these Terms.
3. Account Registration and Responsibilities
To access certain features of Quikit, you may be required to create an account. You must provide accurate, complete, and up-to-date information. You are responsible for safeguarding your account credentials, including your username and password.
By registering an account, you agree to:
- Keep your login credentials confidential
- Notify Quikit immediately if you suspect unauthorized use of your account
- Take full responsibility for any activity under your account, whether authorized by you or not
Quikit shall not be liable for any loss or damage arising from your failure to maintain the security of your account.
4. Payment and Subscription
Certain features or services on Quikit may require payment or subscription. By purchasing a subscription or making a payment, you agree to:
- Pay all fees and applicable taxes associated with your use of the paid services
- Provide accurate and valid payment information and authorize Quikit to charge your payment method
- Comply with any additional terms and conditions associated with your chosen subscription plan
You agree that failure to make timely payments may result in suspension or termination of your access to paid features of the Platforms. All subscription fees are non-refundable unless otherwise required by law.
5. Intellectual Property Rights
All content, features, and functionalities available on Quikit’s Platforms, including but not limited to text, graphics, logos, images, software, and design elements, are the property of Quikit or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You are prohibited from:
- Copying, modifying, distributing, or creating derivative works from any part of the Platforms without prior written consent from Quikit
- Using any of Quikit’s trademarks, logos, or proprietary information without explicit permission
Violation of these terms may result in legal action and the immediate termination of your account.
6. User Content and Licenses
You retain ownership of any content you upload, create, or share through Quikit’s Platforms (“User Content”). By posting User Content, you grant Quikit a non-exclusive, worldwide, royalty-free license to use, distribute, modify, display, and reproduce your content for the purpose of operating, promoting, and improving the Platforms.
You represent and warrant that:
- You own the rights to the User Content or have obtained all necessary permissions to use and share the content
- Your User Content does not violate any third-party rights, including intellectual property, privacy, or contractual rights
Quikit reserves the right to remove or disable any User Content that violates these Terms or applicable laws at its discretion.
7. Third-Party Services and Integrations
Quikit may provide access to third-party services or platforms as part of its offering. Your use of these third-party services is governed by their respective terms and conditions, and Quikit does not assume any responsibility for the content, products, or services provided by third parties.
Quikit makes no representations or warranties regarding third-party services and does not endorse them. Any issues or disputes arising from your use of third-party services are solely between you and the third party.
8. Limitation of Liability
To the maximum extent permitted by law, Quikit and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from:
- Your use or inability to use the Platforms
- Unauthorized access to or use of your account or data
- Any content or conduct of any third party on the Platforms, including offensive or illegal conduct of other users or third parties
- Any errors, inaccuracies, or interruptions in the availability of the Platforms
In no event shall Quikit’s aggregate liability exceed the amount paid by you, if any, for access to the Platforms during the six months preceding the date of the claim.
9. Disclaimer of Warranties
Quikit provides its Platforms “as is” and “as available,” without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Quikit does not guarantee that the Platforms will be error-free, uninterrupted, or secure, nor does it make any guarantees regarding the accuracy, reliability, or completeness of any content or information on the Platforms.
10. Termination
Quikit reserves the right to suspend or terminate your account and access to the Platforms at any time, for any reason, and without prior notice, if you violate these Terms or engage in unlawful activity.
Upon termination, all licenses granted to you under these Terms will immediately cease. Quikit will not be responsible for any data loss or unrecoverable User Content after the termination of your account.
Provisions of these Terms that by their nature should survive termination, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability, shall survive.
11. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law principles.
In the event of any dispute or claim arising out of or in connection with these Terms or your use of the Platforms, the parties agree to first attempt to resolve the matter amicably through negotiation.
